A right-to-live lawsuit has been filed on behalf of Sofia Vergara’s fertilised eggs, according to reports.

Amid a continuing legal battle between the Modern Family star and her ex fiancé, Page Six reports that the female embryos have been listed as plaintiffs Emma and Isabella in US court papers.

Businessman Nick Loeb had previously sued the actress for the embryos, which they created when they were still together in 2013.

The lawsuit says that Emma and Isabella, by not being born, have been deprived of an inheritance from a trust, Page Six said.

It asks that the frozen embryos be given to Nick so that they can live and receive the trust set up for them, the report said.

Businessman Nick had previously sued Sofia for the embryos because he longs to become a parent and does not want the “two lives” they created to ”be destroyed or sit in a freezer until the end of time”.
